1. Who we are
Strobo ("Strobo", "we") is an online platform for discovering events and buying tickets, operated by:
TOURINGTUNES Sp. z o.o., ul. Złota 7 lok. 28, 00-019 Warszawa, Poland. Registered in the National Court Register (KRS) under no. 0001053019, NIP 5252968519, REGON 526117150. Contact: [legal@strobo.events].
These Terms govern the use of strobo.events and related services by (A) ticket buyers and event attendees ("Fans") and (B) event organizers, venues, promoters, labels and artists using organizer accounts ("Organizers"). Sections 2–7 apply to Fans, Sections 8–12 to Organizers, the rest to everyone.
PART A — FANS
2. Strobo is a platform, the Organizer is the seller
When you buy a ticket on Strobo, the sales contract is between you and the Organizer of the event. The Organizer is the seller and merchant of record; payment is collected directly to the Organizer's payment account via our payment provider Stripe. Strobo provides the technology (event pages, checkout, ticket delivery, entry control) and is not a party to the ticket sale. Strobo takes no commission on the ticket price.
3. Prices and fees
The ticket price shown is set by the Organizer. At checkout a processing fee (currently 1.6% + 1 PLN or its currency equivalent, shown as a separate line before payment) covers payment processing costs and is passed through; it is not Strobo margin on the ticket. The total shown at checkout is the final amount charged.
4. Tickets, delivery and entry
Tickets are delivered electronically (email with QR code) after successful payment, normally within minutes. Each ticket admits one person and is validated by QR scan at the venue — the first scan wins; keep your QR private. Tickets may be transferred to another person once, using the transfer function; the previous QR is invalidated. Unauthorized commercial resale may result in ticket cancellation where local law so permits and the Organizer's terms so provide.
5. No right of withdrawal; refunds and cancellations
Under Article 16(l) of Directive 2011/83/EU (in Poland: art. 38 pkt 12 of the Act of 30 May 2014 on Consumer Rights), the 14-day right of withdrawal does not apply to tickets for leisure events with a specific date. You will be asked to acknowledge this before payment.
Refunds are governed by the Organizer's refund policy shown on the event page. Regardless of that policy: if the event is cancelled and not rescheduled, you are entitled to a refund of the ticket price from the Organizer; Strobo provides the tools to process it. If an event is significantly changed (date, venue city), the Organizer must offer a refund option in accordance with applicable consumer law. Refunds are returned to the original payment method. The processing fee is refunded when the refund results from cancellation by the Organizer.
Chargebacks. If, instead of requesting a refund, you dispute a payment with your bank or card issuer, and the dispute is decided in your favour, the money is returned to you by your bank and the tickets on that order are cancelled — they stop being valid and will not admit you at the door. While a dispute is under review your tickets remain valid, and if the dispute is decided in the Organizer's favour they are unaffected. A chargeback is not a substitute for the Organizer's refund process. Contact the Organizer directly first, so that a refund can be handled without your tickets being cancelled — their contact details are shown on the event page, on your ticket and in your ticket email, and replying to that email reaches them. Strobo does not act as an intermediary in refund requests, does not decide them, and cannot compel the Organizer to grant one; what Strobo provides is the tooling the Organizer uses to process a refund once they agree to it.
6. Fan accounts and guest checkout
You may buy as a guest with an email address only. Ticket management (viewing, transfer) is available through secure links sent to your email or through an optional account. You are responsible for the accuracy of your email address and for keeping access to it secure.
7. Fan conduct
You agree not to: buy tickets by automated means; circumvent purchase limits; resell tickets in breach of applicable law or the event's terms; forge or duplicate QR codes; use the platform to harass or defraud.
PART B — ORGANIZERS
8. Organizer accounts and Stripe onboarding
Organizer features require an organization account and a connected Stripe account (Stripe Connect Standard). By connecting Stripe you enter into a direct agreement with Stripe, including the Stripe Connected Account Agreement. You are the merchant of record for your ticket sales: you receive the funds, you are responsible for taxes (including VAT on tickets), consumer-law obligations, refunds and chargebacks arising from your sales. Where a chargeback on one of your sales is decided against you, Strobo cancels the tickets on the affected order automatically and returns those seats to your available inventory.
9. Subscriptions
Access to paid plans is sold by TOURINGTUNES Sp. z o.o. as a subscription (monthly or annual, plans and limits as published on the pricing page). Prices are exclusive of VAT where applicable; VAT is calculated at checkout. Subscriptions renew automatically until cancelled; cancellation takes effect at the end of the current billing period. Usage above plan limits is billed as overage per the published rates or may require an upgrade. We may change plan pricing with at least 30 days' notice, effective from the next billing period.
10. Organizer obligations, permissions and indemnity
(a) The event is yours. You are solely responsible for the event you publish on Strobo: for holding it, for its lawfulness, and for everything the law requires of the person holding it. Strobo provides ticketing technology and holds no event of its own.
(b) What you warrant. You warrant, for each event you publish and for as long as tickets to it are on sale, that:
- your event is lawful and is described accurately, and the ticket inventory you publish is real;
- you hold every permit, authorisation, notification and approval the event requires, including — where the event qualifies as one — the obligations attaching to a mass event (impreza masowa) under Polish law, and the equivalent requirements of any other country in which you hold an event;
- you hold the music rights the event requires and will pay the royalties due to collecting societies (ZAiKS and the neighbouring-rights societies, or their equivalents elsewhere). Obtaining those licences and paying those royalties is yours, not ours, and Strobo does not report, collect or remit on your behalf;
- you hold the rights to everything you upload — posters, photographs, logos, recordings, artist names and likenesses — and to everything you ask us to display;
- the venue is fit and permitted for the event, you will not sell beyond its lawful capacity, and you are responsible for safety and crowd control at it;
- any age restriction shown on the event page is one you will enforce at the door;
- you will honour the tickets you sell and the refund policy you published with them;
- you will comply with consumer protection, tax and event-safety law in each country where you sell.
You must not use Fan data exported from Strobo in breach of the DPA (see Section 13) or applicable marketing law.
(c) Indemnity. You will indemnify TOURINGTUNES Sp. z o.o., and hold it harmless, against any claim, demand, administrative fine, penalty, damages award or reasonable legal cost that arises from your breach of (b) or from the event itself — including claims brought by attendees, by public authorities, by a collecting society, or by the venue. This does not apply to the extent the claim is caused by Strobo's own breach of these Terms, its willful misconduct or its gross negligence.
(d) Strobo does not verify. Strobo does not check your permits, licences or royalty payments and does not assume responsibility for them by making ticketing available to you. We may ask you for evidence of them and may suspend an event or an account under Section 12 if it is not produced; neither the asking nor the suspension transfers any part of this Section to us.
(e) Where you are a consumer. Nothing in this Section applies to you to the extent it would deprive you of a protection that the law grants you as a consumer and that cannot be excluded by agreement. If you hold events as a natural person outside a registered business — including under Polish działalność nierejestrowana — that limit may apply to you; it narrows this Section rather than displacing it, and the warranties in (b) that repeat obligations the law already places on the person holding an event are unaffected.
11. Platform fees on ticket sales
Strobo charges Organizers no commission on ticket sales. The buyer-facing processing fee (Section 3) covers payment costs. Strobo's revenue from Organizers is the subscription (Section 9).
12. Suspension and termination (Organizers)
We may suspend or terminate organizer accounts used for fraudulent, unlawful or abusive activity, including fake events or systematic consumer-law violations. Where feasible we will warn you first. On termination you may export your data (events, orders, contacts) for 30 days.
PART C — GENERAL
13. Data protection
Our processing of personal data is described in the Privacy Policy. For Fan data processed on behalf of Organizers (guest lists, marketing contacts), the Data Processing Agreement (DPA) forms part of these Terms for Organizers.
14. Intellectual property
Strobo, its software, design and trademarks belong to TOURINGTUNES Sp. z o.o. or its licensors. Organizers grant Strobo a non-exclusive license to display event content (names, images, descriptions) for operating and promoting the platform. Organizers warrant they hold rights to content they upload.
15. Availability and liability
We aim for high availability but the service is provided "as is" to the extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (including our liability for willful misconduct, or mandatory consumer rights). Otherwise, to Organizers our aggregate liability in any 12-month period is limited to the subscription fees paid in that period; we are not liable for the acts or omissions of Organizers toward Fans, nor for lost profits or indirect damages.
16. Governing law and disputes
These Terms are governed by Polish law. If you are a consumer, you also enjoy the mandatory protections of the law of your country of residence, and you may sue or be sued in your local courts. EU consumers may use the European ODR platform (ec.europa.eu/consumers/odr). For Organizers, the courts competent for the seat of TOURINGTUNES Sp. z o.o. have jurisdiction.
17. Changes to these Terms
We may amend these Terms for valid reasons (legal changes, new features, security). Material changes will be announced at least 14 days in advance (email or in-product). Continued use after the effective date constitutes acceptance; Organizers may terminate before the effective date if they do not accept changes.
